The House of Representatives is expected to begin consideration of the 21st Century AIRR Act (H.R. 2997) next week.
The bill contains a provision requiring the Federal Aviation Administration to follow notice and comment procedures in the context of changing its so-called One Engine Inoperative (OEI) standards for navigable airspace.
In June, NAREIT and a group of real estate organizations wrote to the House Transportation and Infrastructure Committee, where the bill originated, to express support for keeping the measure in the bill. The OEI standard impacts development in communities near airports, so the real estate organizations feel it is important to undertake a comprehensive cost-benefit analysis and seek input from stakeholders prior to making a change that could significantly impact existing buildings and future development.
