The House of Representatives passed the FAA Reauthorization Act of 2018 (H.R. 4) on Friday, April 27.
The bill contains a provision requiring the Federal Aviation Administration to follow notice and comment procedures in the context of changing its so-called One Engine Inoperative (OEI) standards for navigable airspace.
This provision addresses the concerns raised by Nareit and other real estate organizations in a letter sent to House Transportation and Infrastructure Committee last June. The OEI standard impacts development in communities near airports. Therefore, it is important that the FAA undertake a comprehensive cost-benefit analysis and seek input from stakeholders prior to making a change that could significantly impact existing buildings and future development.
The Senate is expected to act on its own legislation to reauthorize the FAA in the coming months.
